you can find the terms of service for facebook here: http://www.facebook.com/legal/terms?_fb_noscript=1

Basically it says that as long as your intellectual property content is on Facebook (even if you delete it, but it's still on facebook because your friends shared it), Facebook can use it however they want. It appears that you still keep rights to it though. I doubt they could sue you for publishing your own picture in a magazine just because you posted it to facebook first, but take a look at what the RIAA is doing - stranger things have happened.

Very interesting and insightful piece. I am wondering though, when I post anything on FB or upload a picture, they automatically have copyright on it. But does that mean I lose copyright on my thoughts, comments, images? Or do we have shared copyright? Thanks

Thanks Anne! I'm glad there are people out there like you who understand what's at stake here. I wrote this piece mostly because I quit facebook and nobody understood why. I think it's really important to talk to people about what they're actually giving up when they click on "I agree" for these ubiquitous web services.

This piece is truly incredible. I couldn't agree more with your arguments. I feel as though you've put to words my thoughts and observations over the past six months or so since I decided to quit Facebook. It's encouraging to know people are becoming more informed and active about these immensely important issues. I will be sharing your writing with as many as possible. Thank you so much for writing this accurate, informative, thorough and necessary article. Not many are determined to express their opinion as elegantly as you have. Cheers!

Thanks for reading, Jason. I'm glad you got something out of this post. When i started this blog I figured it would be a way to share with some of my close friends, but this post has really taken off, and I'm glad people are reading it because, you're right, it is sobering stuff. Feel free to share this post with your friends, even if you have to do it through facebook!

Thanks for this insightful summary of the inner workings of Facebook. I particularly learned a lot about the ubiquitous 'like' button, and how it helps Facebook to track visited sites even when you don't use it. Sobering stuff.
